摘要
文章从观念、机制、监督、队伍建设等几个方面论述了实现司法公正的条件和途径。指出:更新观念是实现司法公正的根基;程序公正是司法公正的运行机制;加强监督是实现司法公正的保障;队伍建设是实现司法公正的条件。文章认为,世贸组织的基本原则、制度将对我国的司法改革发生重大的影响,"公平、透明、独立和统一"已成为我们司法改革的具体目标。
This paper discusses the conditions and ways of achieving judicial justice by exploring such factors as concept, mechanism, surveillance and contingent. It points out: the change of concepts is the basis of achieving judicial justice;the justice of legal procedures is the working mechanism of judicial justice; strengthening surveillance is the guarantee of achieving judicial justice;the building of contingent is the condition of achieving judicial justice. The paper concludes that the principles and system of WTO are exerting tremendous influences on the judicial reform in China, and that the principle of justice, transparence, independence and unityhas turned into the specific goal of the judicial reform in China.
