摘要
新时代党中央提出依法治国方略,建设社会主义法治国家,指出要推进以审判为中心的诉讼制度改革,确保侦查、审查起诉的案件事实证据经得起法律检验。当前,必须立足于依法治国背景,从启动模式、运用领域、对象与方式、实施程序等司法鉴定救助的实践运作出发,解决司法鉴定救助制度在立法层面、救助资源、救助对象和范围等方面存在的问题,寻求司法鉴定救助制度的改革路径,强化相应的监管措施,唯有如此,新时代司法鉴定救助制度才能被完整地建立和更进一步健全。
In the new era,a strategy ruling the state according to law and constructing a socialist country ruled by law was proposed by the CPC Central Committee.It was pointed out the target to promote the reform of litigation system which center is trial,to ensure that the case evidences of investigation and prosecution can meet the legal standards.Currently,based on the background of governing the country by law,we must start from the practical operation of forensic identification assistance,such as start-up mode,application field,rescue object and way,implementation procedure,etc.,solve the problems existing in the aspects of legislation,rescue resources,rescue objects and scope,seek the reform path of forensic identification assistance system,strengthen the corresponding supervision measures.Then,the system of forensic identification assistance can be integrally established and further improved in the new era.
