摘要
案例研究定位于理论、政策和实践的互动结合。随着互联网金融的快速发展,互联网金融领域个人征信权益保护工作涌现出一些新情况新问题,成为人民群众征信服务和征信维权的集中难点。互联网金融领域个人征信权益保护主要面临身份信息被冒用导致个人征信逾期信息应由"谁举证"、互联网金融机构因经济利益主动核查和修改报送信息的动力不足、利用法律漏洞侵害互联网金融消费者征信合法权益、警惕少数不法分子借道个人征信系统非法揽财等突出问题。研究解决互联网金融领域侵犯个人征信合法权益的行为,对于提升人民群众在征信领域的幸福感和获得感、维护人民银行个人信用报告的公信力、促进征信行业健康稳定发展具有重要现实意义。
Case studies,which are based on the interaction of theory,policy and practice,are an effective way to study and analyze the infringement of individual credit rights and interests in the field of Internet finance.With the rapid development of Internet finance,some new situations and problems have emerged in the field of Internet finance to protect the rights and interests of individual credit reporting,which has become the focus of the people’s credit reporting services and rights protection.The protection of personal credit information rights and interests in the field of Internet finance is mainly faced with such prominent problems as the misuse of identity information,the lack of motivation for Internet financial institutions to actively verify and modify the information submitted due to economic interests,the infringement of legal rights and interests of Internet financial consumers by using legal loopholes,and the vigilance of a small number of illegal individuals to illegally collect money through personal credit information system.To study and solve the infringement of the legal rights and interests of individual credit reporting in the field of Internet finance is of great practical significance for improving people’s sense of happiness and acquisition in the field of credit reporting,maintaining the credibility of personal credit reporting of the People’s Bank of China,and promoting the healthy and stable development of the credit reporting industry.
