摘要
受贿罪是指国家工作人员利用职务便利 ,索取他人财物或非法收受他人财物 ,为他人谋取利益的行为。受贿罪有三种类型 :标准型受贿罪 ;准受贿罪 ;斡旋受贿罪。三种受贿罪都有不同的客观要件 ,在实践中也存在着分歧之处需要完善 ,使国家工作人员在职务行为中保持廉洁。
Any state functionary who,by taking advantage of his postion,extorts money of property from another person,or illegally accepts another persons money or property in return for securing benefits for the person shall be guilty of acceptance of bribes.Guilty of acceptance of bribes is divided into three types which are typical guilty of acceptance of bribes,quasi-guilty of acceptance of bribes and mediatory guilty of acceptance of bribes.Three types of guilty of acceptance of bribes have their own objective requirements.In the juridiecal practice,there are many arguments on the objective requirements of guilty of acceptance of bribes.In order to make state functionary keep probity and self-discipline,the objective requirements of guilty of acceptance of bribes should be contummated.
