摘要
法律在现代法治社会建设过程中并非万能:一方面法律文本自身存在漏洞;另一方面存在法律执行无法覆盖到的角落,往往离不开道德的弥补。因此,需要正确认识和处理现代法治与道德建设的关系,通过道德法律化和法律道德化融合共同致力于促进依法治国与以德治国相结合。同时,加强现代法治社会的道德建设应该汲取儒家传统道德资源的精华,从理念与实施手段两方面来学习借鉴儒家传统道德,进而推动社会主义法治建设现代化与国家建设现代化。
In the process of building a modern legal society,the law is not a panacea:on the one hand there are loopholes in the legal text itself;on the other hand the presence of law enforcement was unable to cover the corner,often inseparable from the moral remedy.Therefore,to correctly understand and handle the relationship between the modern rule of law and moral construction,by moral law and legal ethics together to promote the integration of the rule of law and to Morals combined.At the same time,strengthen the moral construction of modern law society should learn the essence of traditional Confucian moral resources,from concept and means of implementation,both to learn from the traditional Confucian ethics,thus promoting the rule of law and building a socialist modernization and building a modern country.
