摘要
群岛制度的法理基础是地理上的整体性和通过政治、经济、历史等要素使群岛具有紧密联系而拟制的整体性。洋中群岛同样能满足其整体性特别是拟制整体性要求。洋中群岛作为整体划定直线基线在法理上是成立的。大陆国家对洋中群岛普遍适用直线的实践和法律确信表明对洋中群岛划定直线基线已形成习惯国际法。综合考虑各方面因素,建议对南沙群岛相关岛礁群采用'区块式'方案划定直线基线。区块选择时应考量我国建设海洋强国的'海洋自由'发展诉求、重要航道的航行自由、海域划界的利弊等因素。
The legal basis of the archipelago system is the geographical integrity and the fictional integrity that is formulated by the close connection of islands through political,economic,historical and other factors.The mid-ocean archipelago can also meet the integrity requirements,especially the fictional integrity requirements.The straight baseline of the mid-ocean archipelago as a whole is legally established.The common practice and legal convictions of the mainland countries indicate that a straight baseline for the mid-ocean archipelago has formed customary international law.Taking into account various factors,it is recommended that a'block'approach be adopted for the relevant island reefs in the Nansha Islands to define a straight baseline.When selecting the block,we should consider the factors such as the development of'freedom of the sea'in the construction of a maritime power,the freedom of navigation of important waterways,and the advantages and disadvantages of maritime delimitation.
