摘要
截至1998年7月,我国已经在至少17个双边投资条约中一揽子全盘接受了ICSID仲裁管辖权,而我国所签订的所有双边投资条约中都有最惠国待遇条款,这些条款很可能使得我国对ICSID仲裁管辖权的全盘接受扩大化。在今后缔结双边投资条约的时候,我国不但应该重新坚持部分接受ICSID仲裁管辖权的立场,而且还应该明确主张最惠国待遇条款不适用于争端解决程序。
As of July 1998,China has completely accepted ICSID jurisdiction in at least 17 BITs,while all the BITs concluded by China contain Most-Favored-Nation treatment clause capable of making China’s acceptance of ICSID Jurisdiction extended.When concluding BITs in the future,China should not only stick to the position of partial acceptance of ICSID jurisdiction again,but also explicitly clarify that the Most-Favored-Nation clause does not apply to treatment pertaining to dispute settlement.
