摘要
由于征地制度改革滞后,再加上相关政策规定模糊,导致失地农民社会保障中的边界模糊不清,具体表现为各方对地方政府到底应为失地农民的社会保障负多少责任,失地农民长远生计有保障的具体标准,以及何种情形下的失地农民生活困难应由地方政府负责等问题,都存在很大分歧。边界模糊是诱致征地冲突复发机制的主要原因,它既会使当前征地冲突的化解出现反复和波折,也会使已平息的征地冲突死灰复燃。要消解征地冲突的复发机制,既需要划清中央政府与地方政府之间的责任边界,也需要厘清地方政府与用地企业之间的责任边界,还需要对地方政府的责任边界和失地农民的权利边界进行明晰化。
The boundaries in land-lost peasants’ social security are obscure because the lagging of land expropriation and relevant vague policies.In specific,Not only responsibility of local governments but also standard of land-lost peasants’ social security are divergent. Furthermore,there are lots of argues between peasants and officials about which situation of peasants’ difficult should local government solving. Vague boundaries are main causes of land expropriation conflicts because they not only make current conflict more difficult to dissolve but also can awaken dissolved conflicts. It is necessary to define responsibility boundaries both between central government and local governments and between local governments and enterprise which using lands. At the same time we should clearly define the boundary between land-lost peasants’ social security rights and local governments’ obligation.
