摘要
劳动权作为公民基本权利与当代人权的重要组成部分,由刑法介入予以保护具有法理及实践的必然性。立足于轻罪立法的刑事治理背景与劳动法“倾斜保护”的价值构造,我国围绕劳动权的刑法保护亦当通过劳动犯罪圈的适度扩大而得到加强。学理上,劳动犯罪可被区分为纯正劳动犯罪与不纯正劳动犯罪,仅前者有必要成为劳动刑法立法论的研究对象。基于对劳动法益的类型化梳理,应分别考察增设或修改就业歧视罪、雇用童工罪、恶意违反最低工资标准罪及拒不缴纳社会保险基金罪等劳动罪名的法理基础与规范实益,通过适当的新罪增设实现对劳动法益的周延覆盖。就劳动刑法的规范表达,为协调劳动法与刑法间的法秩序统一性、确保规范变动的灵活性,宜在充分把握分散式立法模式利弊的基础上,考察创制性附属刑法在我国劳动法治领域发挥效用的可能。
As an important component of civil basic rights and contemporary human rights,the protection of labor rights through criminal law is inevitable in both legal theory and practice.Based on the criminal governance background of legislation on minor offenses and the value structure of“biased protection”in labor law,China s criminal protection of labor rights should also be strengthened through the moderate expansion of the labor crime circle.In theory,labor crimes can be divided into pure labor crimes and impure labor crimes,and only the former is necessary to become the research object of labor criminal law legislation.Based on the categorization of labor legal interests,the legal basis and normative benefits of adding or modifyinglabor crimes such as employment discrimination,employingchild labor,malicious violation of minimum wage standards,and refusal to pay social insurance funds should be examined separately.By adding appropriate new crimes,the comprehensive coverage of labor legal benefits can be achieved.Regarding the normative expression of labor criminal law,in order to coordinate the unity of legal order between labor law and criminal law and ensure the flexibility of normative changes,on the basis of fully weighing the advantages and disadvantages of the decentralized legislative mode,it is appropriate to investigate the possibility of the comprehensive application of the creative accessory criminal law in the field of labor rule of law in China.
