摘要
随着ChatGPT引发的GenAI研究热潮,借助GenAI技术嵌入刑事侦查,提升侦查效率成为可行选择。应当发挥侦查伦理作为刑事侦查基本规范的作用,从侦查伦理是刑事侦查基本规约这一命题出发,通过剖析以ChatGPT为代表的生成式人工智能技术本质及其融入刑事侦查场景的具体实践路径,揭示侦查智慧化趋势由于过度强化侦查技术引发的伦理风险类型及成因。建立起从技术维度优化算法、从伦理维度明确伦理边界、在法律维度建构全链条规范的应对进路,以期最大限度降低伦理风险,发挥技术参与治理的最大社会效益。
The research boom in Generative AI sparked by ChatGPT has made it viable to utilize Generative AI technology in criminal investigation to improve efficiency.It is essential to leverage investigative ethics as the fundamental norm in criminal investigations.Starting from the proposition that investigative ethics serves as the basic regulatory framework for criminal investigations,this paper analyzes the essence of generative AI technologies,represented by ChatGPT,and their specific practical integration into criminal investigation scenarios.It aims to reveal the ethical risks and their causes associated with the trend of intelligent investigative practices,which arise from the excessive emphasis on investigative technologies.To address these risks,a comprehensive approach is proposed,encompassing optimizing algorithms from a technical perspective,clearly defining ethical boundaries from an ethical perspective,and establishing a full-chain regulatory framework from a legal perspective.The goal is to minimize ethical risks and maximize the social benefits of technology-assisted governance.
