摘要
口供一般是指犯罪嫌疑人的供述和辩解,是刑事诉讼法所规定的八类证据之一。与一般的实物证据相比较,口供收集的时间更短、司法资源的消耗更少和证明的效果更加直接而全面,是司法办案据以定案的关键性证据,在我国曾经有“证据之王”之称。文章以D等3人容留卖淫案中的证据,尤其是口供中的大量矛盾点为切入点,分析了共同犯罪案件中审查口供的方向和步骤。探讨了在面对犯罪嫌疑人翻供、口供之间以及口供与证人言辞证据之间存在矛盾点时,如何通过辅助证据进行进一步分析、采信和印证,发挥口供在定罪量刑中的重要作用,达到“证据确实、充分”的证明要求,实现证明犯罪的最终目的。
Statements,typically referring to the confessions and defenses of criminal suspects,constitute one of the eight types of evidence stipulated in the Criminal Procedure Law of China.Compared with physical evidence,statements are collected in a shorter timeframe,consume fewer judicial resources,and provide more direct and comprehensive proof,serving as crucial evidence for judicial case adjudication.In China,statements have been known as the "king of evidence." This paper takes the evidence in the prostitution solicitation case involving three individuals,including D,as its starting point,particularly focusing on the numerous contradictions in the statements,to analyze the directions and steps for examining statements in joint crime cases.The paper discusses how to further analyze,accept,and corroborate statements through supplementary evidence when confronted with contradictions in suspects' changing statements,between statements,and between statements and witness testimonies,thereby playing a significant role in conviction and sentencing,meeting the requirement of "definite and sufficient evidence," and achieving the ultimate goal of proving guilt.
