摘要
“努力让人民群众在每一个司法案件中感受到公平正义”是党的二十大报告中明确提出的要求。社会热点案件是司法进入公共视域的入口,对于司法形象的树立尤为重要。社会热点案件中的舆情形成受到镜像效应和“司法外”效应的影响,呈现出意见单极化、理性和非理性交织、社会情绪带入等特征,需要司法与媒体的双向调控才能实现有效治理。一方面,需要司法恪守冷静、开放、审慎等品格;另一方面,需要通过规则设置、政策治理等方式重塑媒体在公共领域的功能,只有这样才能塑造良好的司法形象,让公平正义在每一个具体的案件中被公众所感受。
"Endeavouring to let the people feel fairness and justice in every court verdict"is a requirement clearly set out in the report to the 2Oth National Congress of the Communist Party of China(CPC).Hot-button social cases are the entry point for the judiciary into the public eye,and are particularly important for the establishment of the judicial image.The formation of public opinion in social hotspot cases is affected by the mirror effect and the'extrajudicial'effect,presenting the characteristics of unipolarised opinions,interweaving of rationality and irrationality as well as the introduction of social emotions,etc.,which requires two-way regulation by the judiciary and the media to achieve effective governance:on the one hand,the judiciary needs to abide by the character of calmness,openness and prudence;on the other hand,it needs to reshape the function of the media in the public sphere through rule-setting and policy governance.On the one hand,the judiciary needs to abide by the character of calmness,openness and prudence;on the other hand,it needs to reshape the function of the media in the public sphere through the setting of rules and policy governance.Only in this way can we shape a good image of justice,so that fairness and justice are felt by the public in each specific case.
