摘要
[研究目的]生成式人工智能对个人信息保护产生了较大的冲击,以侦查为视角探讨如何解决此问题对于加强个人信息保护,发挥生成式人工智能的价值具有重大意义。[研究方法]通过梳理、分析文献,及考察实践状况,总结概括了生成式人工智能赋能侦查对个人信息形成冲击的背景,生成式人工智能、侦查、个人信息三者之间的关系,以及生成式人工智能嵌入侦查对个人信息保护的具体影响。[研究结论]为了最大化地发挥生成式人工智能的功用,规范侦查行为,强化个人信息保护,应该贯彻最小必要原则、调适知情同意规则、加强算法监管、保障数据准确完整、建立场景化监管制度。
[Research purpose]Generative artificial intelligence has had a significant impact on personal information protection.Exploring how to solve this problem from the perspective of investigation is of great significance for strengthening personal information protection and unleashing the value of generative artificial intelligence.[Research method]By reviewing and analyzing literature,as well as examining practical situations,the background of the impact of generative artificial intelligence empowered investigation on personal information is summarized,the relationship between generative artificial intelligence,investigation,and personal information is discussed;the specific influence of generative artificial intelligence investigation on personal information protection is explored.[Research conclusion]In order to maximize the effectiveness of generative artificial intelligence,regulate investigative behavior,and strengthen personal information protection,investigation of crimes should implement the principle of minimum necessity,adapt informed consent rules,strengthen algorithm supervision,ensure data accuracy and completeness,and embed scene supervision.
