摘要
行政复议变更决定的优先适用是指复议机关审理复议案件时应先进行变更考察,不适合变更的,才考虑撤销等其他决定类型。行政复议变更决定的优先适用契合行政复议的立法目的,有利于统一法律适用、激发复议机关复议能动性。其优先适用具有深厚的理论基础,在逻辑上归因于行政复议制度的职权主义,在目标导向上指向实质性化解行政争议。据此,为推动新《行政复议法》实施后行政复议变更决定优先适用的制度建构,应厘清事证瑕疵类、事证明确类、违反法定程序类以及超越或滥用职权类下行政复议变更决定的适用范围。
The priority application of administrative reconsideration change decisions refers to the fact that when the reconsideration authority reviews reconsideration cases,it should first conduct a change examination.If a change is not suitable,it should then consider other types of decisions such as revocation.The priority application of administrative reconsideration change decisions aligns with the legislative purpose of administrative reconsideration,which is conducive to the unification of legal application and the stimulation of the proactivity of the reconsideration authority.Its priority application has a profound theoretical foundation,which is logically attributed to the authority doctrine of the administrative reconsideration system,and is target-oriented towards the substantive resolution of administrative disputes.Accordingly,to promote the institutional construction of the priority application of administrative reconsideration change decisions after the implementation of the new"Administrative Reconsideration Law,"it is necessary to clarify the scope of application of administrative reconsideration change decisions in categories such as evidential defects,clear evidence,violations of statutory procedures,and exceeding or abusing authority.
