摘要
地域性是地理标志最核心的特征,该特征使得地理标志保护面临重叠保护、“公地悲剧”以及侵权救济难等困境。为了摆脱上述困境,文章认为,应明确地理标志的内涵,借鉴国内外相关经验,整合现有地理标志保护制度。针对地理标志保护的困境,可确立保护在先权利原则和共存规则,以解决重叠保护问题;严格权利主体标准和规范使用行为,以预防“公地悲剧”的发生;扩大诉讼主体范围和明确正当使用的条件,以解决侵权救济难题。
Regional specificity is the core feature of geographical indications,which poses challenges to the protection of geographical indications,such as overlapping protection,“tragedy of the commons”,and difficulties in resolving infringement.In order to overcome the above difficulties,the article suggests to clarify the connotation of geographical indications,integrate the existing protection system with relevant experience at home and abroad.Firstly,establish the principle of“protection comes first”and coexistence rules to address the problem of overlapping protection;Secondly,set strict standards and norms for the use of rights holders to prevent tragedy of the commons;Thirdly,expand the scope of litigation subjects and clarify the conditions for legitimate use to solve the issue of infringement relief.
