摘要
具有公开募捐资格的慈善组织需要代表公众捐赠意愿进行慈善财产处置,涉及面广、关注度高,其监管问题事关公众对慈善事业的认知和行业公信力。尽管我国已建立了一套链条完整的监管体系,监管力度较大、标准较为严格,但仍存在财产募集管理使用不合规、内部治理乱象、信息公开不到位等问题。应以党的二十届三中全会精神为指导,以贯彻落实新修改的《慈善法》为契机,以改革破题,完善法规政策体系、健全综合监管机制、提升行政执法能力、加强组织内部治理,不断织密织牢监管“安全网”,建立健全符合新时代高质量发展要求的中国特色现代慈善组织制度。
Charitable organizations with public fundraising qualifications need to handle charitable property on behalf of the publicdonation willingness,which is wide coverage,high attention,low tolerance,and easy to cause public opinion.Supervision is related to the publiccognition and credibility of charity.Although China has established a complete regulatory system,which is stricter than that of private charitable organizations,there are still problems such as non-compliance in the management and use of property raising,chaotic internal governance,and inadequate information disclosure.From time to time,charitable organizations with public fundraising qualifications fall into a crisis of public trust.We should take the spirit of the Third Plenary Session of the 20thCPC Central Committee as guidance,and take the implementation of the newly revised Charity Law as an opportunityto improve the system of regulations and policies,ameliorate the comprehensive supervision mechanism,enhance the ability of administrative law enforcement,strengthen the internal governance of organizations,constantly weave a tight regulatory"safety net",and establish a modern charity organization system with Chinese characteristics that meets the requirements of high-quality development in the new era.
