基于教育法典编纂的教育法学学科建设

On the Discipline Construction of Education Law Based on the Codification of Education Code

摘要 教育法学学科建设与教育法典编纂是相互影响、相互促进的关系,教育法学的学科要素为教育法典编纂奠定现实基础,教育法典编纂则推动教育法学学科的知识系统化、理论研究深入化、学科教育体系化、学科地位独立化。教育法典编纂要求教育法学学科坚持以问题为导向,以理论为基础,以教育规律和法治规律为遵循,以专业人才培养为使命,通过聚焦教育治理实践、提升学科服务面向、加强学科交叉融合,加快教育法学学科建设。 The relationship between the discipline construction of education law and the codification of education code is mutually influencing and reinforcing. The disciplinary elements of education law lay a realistic foundation for the codification of education code, while the codification of education code promotes the systematization of the knowledge, the in-depth theoretical research, the systematization of the education, and the independence of the disciplinary status for the discipline of education law. The codification of education code requires the discipline of education law to adhere to a problem-oriented and theory-based approach, follow the laws of education and the rule of law, and take the training of professionals as its mission, thereby accelerating the discipline construction of education law by focusing on the practice of education governance, enhancing the service orientation, and strengthening the interdisciplinary integration.
