摘要
平台经济快速发展的同时也呈现出诸多问题,面对电商领域知识产权治理的复杂性,亟待探索契合平台现实需要的公私协同治理模式。政府行政规制模式存在运动式执法导致效果不稳定以及相关知识产权维权援助机构属性不明的不足,而企业自我规制模式则可能因平台作为治理者的正当性和中立性受质疑而存在缺陷,这使得传统治理模式陷入失衡。为克服这种缺陷,有必要借鉴公私合作模式,将主体包容性与价值多元化的理念融入电商平台知识产权治理的各个环节,并以包容审慎作为基本原则。公私协同模式能缓解公私部门在应对电商知识产权治理中的紧张关系,通过强化开放型共治组织架构、加强交互型共治规范建设以及落实制衡型共治权责配置等举措,提升知识产权综合治理的实际效益,实现多元共赢的治理目标。
With the rapid development of the platform economy,many problems have emerged.Faced with the complexity of intellectual property(IP)governance in the field of e-commerce,it is urgent to explore a public-private collaborative governance paradigm that suits the practical needs of the platform.Due to the unstable effectiveness of the administrative regulation model of the government and the unclear attributes of relevant IP rights protection and assistance organizations,as well as the flaws in enterprises self-regulation model,which may be questioned by the legitimacy and neutrality of the platform as a regulator,the traditional governance model is in an imbalanced predicament.To overcome such shortcomings,it is necessary to draw on the public-private partnership model,incorporate the concepts of subject inclusiveness and value plurality into all aspects of the IP right governance of e-commerce platforms,with inclusiveness and prudence as the basic principle.The public-private collaboration model can alleviate the tension between the public and private sectors in dealing with e-commerce IP governance,and enhance the practical benefits of comprehensive IP governance and achieve the governance goal of win-win in diversity by strengthening the organizational structure of open shared governance,strengthening the construction of norms for interactive shared governance,and implementing the allocation of powers and responsibilities for check-and-balance shared governance.
