摘要
输入型脑机行为是脑联网时代的新概念,需要引起法律人的关注,因为任何新技术的产生都伴随着被用作犯罪工具的可能。如果仅讨论被他人操控的行为不成立犯罪,那么就使自己陷入被他人操控状态下的犯罪恶意将无法被归责。原因上自由行为理论的行为整体性和责任能力的意思主义观点,恰好解决了输入型脑机行为意思表示与动作主体分离,责任能力与动作主体不同时存在的问题,是对输入型脑机行为进行归责的理论基础。
Input type brain computer behavior is a new concept in the era of brain networking,which needs to attract the attention of legal professionals,because the emergence of any new technology is accompanied by the possibility of being used as a criminal tool.If only discussing behavior manipulated by others does not constitute a crime,then the malice of committing a crime that puts oneself in a state of being manipulated by others will not be held accountable.The holistic perspective of the theory of free behavior and the interpretive view of responsibility ability precisely solve the problem of the separation of intention expression and action subject in input type brain machine behavior,and the coexistence of responsibility ability and action subject,which is the theoretical basis for attribution of responsibility in input type brain machine behavior.
