摘要
在刑法客观主义与法秩序统一的价值立场下,必须对交通肇事罪中两档升格法定刑的适用范围进行严格限缩。认定“肇事后逃逸”应当以不履行刑法所规定的救助义务为限;《关于审理交通肇事刑事案件具体应用法律若干问题的解释》中“为逃避法律追究而逃跑”不宜作为认定“逃逸”的充分条件,而应理解为在《刑法》第133条所规定的构罪客观要件的基础上,为实现对成立“逃逸”范围的进一步限缩而增设的主观要件。另外,认定“因逃逸致人死亡”应当以肇事者的行为满足交通肇事罪的基本犯罪构成为前提;就罪数关系的处理,该档法定刑升格条件宜定位为包容型结合犯。因此,在被害人死亡结果用于构成该罪基本犯的场合下不应适用升格法定刑,否则即构成对刑法中禁止重复评价原则的违反。
The application scope of the two levels of aggravated statutory penalties for crimes of causing traffic casualties must be strictly limited under the value position of objectivism in criminal law and the unity of the legal order.This study holds the view that the determination of"hit and run"should be limited to the failure to fulfill the duty of assistance stipulated in The Criminal Law,and that"escaping to avoid legal accountability"in The Interpretation on Several Issues Concerning the Specific Application of Laws in the Trial of Criminal Cases of Traffic should not be considered as a sufficient condition for determining"escape",but should be understood as an subjective element added on the basis of the objective elements of the offense stipulated in Article 133 of The Criminal Law in order to further limit the scope of"escape".In addition,the determination of"causing death due to escaping"should be based on the premise that the perpetrator′s actions satisfy the basic criminal elements of the crimes of causing traffic casualties,and in terms of the relationship between the number of offenses,the conditions for upgrading the legal penalty in this category should be positioned as an inclusive combination of offenses.Therefore,in cases where the death of the victim is used to determine the basic offense of the crime,the aggravated statutory penalty should not be applied,as it would violate the principle of prohibiting repeated evaluation in criminal law.
