摘要
大型网络平台通过数据聚集对用户个人信息以及平台间竞争产生显著影响。一方面,大型网络平台基于资源和地位上的非对称性,对平台内活动负有监管的职责;另一方面,大型网络平台存在滥用“数字权力”的风险,故应当加强对其监管。通过网络平台“守门人”制度向部分大型网络平台施加一定的加重义务,有助于优化我国网络平台监管制度。我国现有的网络平台“守门人”制度,一方面在立法中呈现碎片化特征,忽视了各部门法在网络平台监管中的有机联系;另一方面现有网络平台分类分级不甚合理,“守门人”义务主体认定标准过于笼统。为完善我国网络平台“守门人”法律制度,应当革新网络平台监管理念、加强网络平台反垄断监管与个人信息保护的协作,建立科学的网络平台分类分级标准、明确“守门人”义务主体的认定标准,构建多元立体的监管模式、加强网络平台的自我监管,以实现网络平台的有效治理,促进网络平台的健康发展。
Large network platforms have a significant impact on users’personal information and inter-platform competition through data aggregation.On the one hand,large platforms have the duty to regulate activities within their platforms based on the asymmetry in their resources and status;on the other hand,there is a risk of abuse of“digital power”by large platforms,which should be subjected to enhanced regulation.The“gatekeeper”system of online platforms imposes certain aggravating obligations on some large platforms,which helps to optimize the regulatory systems of online platforms in China.China’s existing online platform“gatekeeper”system presents fragmentation in legislation,ignoring the organic connection of various department laws in online platform supervision.In addition,the irrationality of existing platform classification and grading system may easily trigger disputes over the identification criteria of“gatekeepers”.In order to improve the“gatekeeper”system of China’s online platforms,it is necessary to innovate the concept of supervision,strengthen collaboration between regulation of anti-monopoly and protection of personal information on online platforms,establish scientific platform classification and grading standards,promote pluralistic and stereoscopic supervision,so as to realize the effective governance and promote the healthy development of online platforms.
