摘要
时间银行作为一种新型互助养老模式,是积极应对人口老龄化的重要举措,为供给养老服务和缓解养老压力提供了有益思路,但目前相应的法律保障机制还不够健全。文章引入风险社会理论,对时间银行相关主体的法律关系进行了剖析,指出其在法理上应属于长期型志愿服务关系。针对时间银行在实际运行中存在的法律关系模糊现象,以及其在管理、信息和服务三个层面隐含的安全风险,建议规范时间银行志愿服务协议签订,加强政府对时间银行的监督管理,推进个人信息保护法律制度适老化,保护服务提供者和接受者的合法权益。
As a new mode of mutual care,the time bank is an important measure to actively address the aging population issue,but its operation effect has not reached an ideal state in practice.This paper takes the legal relationship of time bank as the logical starting point,introduces the theory of risky society,and analyzes the legal relationship of each subject in time bank,pointing out that it is more of a long-term voluntary service relationship rather than a labor relationship in jurisprudence.In order to minimize the security risks of time bank,with the ambiguous legal relationship in the actual operation of time bank and its derivative risks in three aspects of management security,information security and service security,it is suggested that the signing of voluntary service agreement of time bank be standardized,the government's supervision and management of time bank be strengthened,the aging of the legal system of personal information protection be promoted,and the legitimate rights and interests of service providers and recipients be protected.
