摘要
2024年1月24日,最高人民法院、最高人民检察院、司法部、全国律协首次召开工作交流会商会,全面贯彻落实党的二十大和二十届二中全会精神,建立法院、检察院、司法行政机关、律师协会“四方会商”机制,聚焦共同关注的律师工作重点领域,强化协作配合,深化良性互动,为推进中国式现代化提供有力支撑和服务。该会议在法律职业共同体建设进程中具有重要意义,有利于加快建立法律职业共同体,促进法官、检察官、律师、法学家等法学领域的专业人士进行有效的沟通交流,为中国特色社会主义法治的进步贡献其自身力量。在法律职业共同体中,律师和法官作为核心成员,对中国法治建设的进程具有较大的影响力,但是由于两个职业的各自特征不同,在法律的运行过程中会产生矛盾和冲突。因此,要从法官和律师的角度出发,积极调和两个职业之间存在的固有矛盾,构建具有中国特色的社会主义法律职业伦理体系,促进我国法律职业伦理体系的发展与进步,推进法治中国现代化建设的进程。
On January 24,2024,the Supreme People's Court,the Supreme People's Procuratorate,the Ministry of Justice,and the All China Lawyers Association held their first working exchange and consultation meeting,comprehensively implementing the spirit of the 20th National Congress of the Communist Party of China and the Second Plenary Session of the 20th Central Committee.They established a"Four-Party Consultation"mechanism among the courts,procuratorates,judicial administrative organs,and bar associations,focusing on key areas of lawyer work,strengthening cooperation,and deepening positive interaction,providing strong support and services for promoting the modernization of Chinese characteristics.The meeting is of great significance in the construction of the legal professional community,conducive to accelerating the establishment of the legal professional community,promoting effective communication and exchange among legal professionals such as judges,prosecutors,lawyers,and legal scholars,and contributing their own strength to the progress of socialist rule of law with Chinese characteristics.As core members of the legal professional community,lawyers and judges have a crucial influence on the process of China's legal construction.However,due to the different characteristics of the two professions,conflicts and contradictions may arise in the operation of the law.Therefore,it is necessary to start from the perspectives of judges and lawyers,actively reconcile the inherent contradictions between the two professions,construct a socialist legal professional ethics system with Chinese characteristics,promote the development and progress of China's legal professional ethics system,and promote the modernization of rule of law in China.
