摘要
失信联合惩戒制度是典型的行政性失信惩戒,具有保护社会公共利益的功能,是缓解市场声誉惩罚失灵问题的中国实践。失信联合惩戒制度以政府安排或引导资源配置的能力范围为有效性边界。在有效性边界之外,失信联合惩戒制度的限制性措施不能消除与企业具有直接交易关系的市场主体存在的市场声誉惩罚失灵问题,在限制具备可替代性的资源分配上因企业寻求“不当帮助”被减弱。本文以理论加实证的方法,对环保严重违法失信企业的商业信用和职工信用等债务性资金的异常变化进行了研究,表明:(1)失信联合惩戒制度不具备如“大炮打蚊子”般的无限有效性;(2)失信联合惩戒制度有着“纱窗挡蚊子”的有效性边界,保护国家资源不受严重违法失信主体染指;(3)失信联合惩戒制度的有效性边界之外发生着“不当帮助”问题,表现为企业严重违法失信后商业信用和职工信用增加。本文关于失信联合惩戒制度存在有效性边界的结论,可为完善社会信用制度、健全诚信建设长效机制提供政策借鉴;强调失信联合惩戒制度对国家资源的联合保护性,可为学术界科学完整认识失信联合惩戒制度提供参考。
The joint punishment system for dishonesty is a prototypical administrative punishment for dishonesty,which has the function of protecting social public interests and is a Chinese practice to alleviate the problem of market failures in reputation-based penalties.The effectiveness boundary of the joint punishment system for dishonesty is determined by the scope of the government’s capability to arrange or guide resource allocation.Beyond this boundary,the restrictive measures under this system fail to rectify the dysfunction of market reputation punishments among the main market players directly trading with enterprises,and the efficacy of such measures in restricting access to substitutable resources is diminished due to the enterprises’seeking“improper assistance”.Adopting a combined theoretical and empirical approach,this study investigates abnormal changes in the debt financing such as commercial credit and employee credit of enterprises with severe environmental law violations and dishonesty,revealing(1)that the joint punishment system for trust-breaking does not have unlimited effectiveness akin to“using a cannon to kill a mosquito”,(2)that the system operates with an effectiveness boundary like“a screen door keeping out mosquitoes”,safeguarding national resources from being encroached by entities with severe legal violations and trust-breaking records,and(3)that beyond the effectiveness boundary of the joint punishment system for dishonesty arises the issue of“improper assistance”,which manifests as an increase in commercial credit and employee credit following severe legal violations and loss of trust on the part of businesses.The findings of this article about the existence of an effectiveness boundary for the joint punishment system can offer policy reference for refining social credit systems and fostering long-term mechanisms for integrity building.By highlighting the system’s collaborative protective role for national resources,this study is also of referential significance to a
