摘要
大数据侦查的广泛应用,节约了司法成本,提升了打击犯罪的效益,但同时也引发了一系列公民个人信息的风险,包含信息收集主体多元化导致全景式监控风险、数据共享增加泄露风险、数据深度挖掘引发滥用风险。其风险产生的原因主要表现为大数据侦查行为定义模糊,个人信息保护法律法规不完善,侦查人员和公民对个人信息缺乏保护意识。通过明确个人信息的含义和大数据侦查行为的性质,严格贯彻比例原则,划分个人信息使用边界,赋予信息主体积极权利,构建大数据侦查中个人信息管理使用的规范机制,从而实现打击犯罪与保护个人信息的的双重目标。
The widespread application of big data investigation has saved judicial costs and improved the effectiveness of combating crime,but at the same time,it has also raised a series of risks to citizens'personal information,including the risk of panoramic monitoring caused by diversified information collection subjects,the risk of data sharing increasing leakage,and the risk of misuse caused by deep data mining.The main reasons for its risks are the vague definition of big data investigation behavior,incomplete personal information protection laws and regulations,and a lack of awareness among investigators and citizens regarding the protection of personal information.By clarifying the meaning of personal information and the nature of big data investigation behavior,strictly implementing the principle of proportionality,dividing the boundaries of personal information use,empowering information subjects with active rights,and constructing a standardized mechanism for the management and use of personal information in big data investigation,the goal of combating crimes while protecting personal information can be effectively achieved.
