摘要
未成年人被性侵的案件近年来呈现了上升趋势,其给涉案的被性侵的未成年人所带来的不仅是身体上的伤害,精神伤害大于同类案件中的成年人,而且是可持续性的。我国现行法律体系下,虽然受害未成年人通过刑事附带民事获得精神损害赔偿,但实践中法院鲜有支持,即使支持,数额也低于民法侵权上的同类赔偿,不足以抚平伤害,也不能起到对犯罪分子的惩罚。鉴于此,我国应当对此类案件建立特殊的规则,增设惩罚性精神损害赔偿,民刑赔偿共存。
In recent years,the number of cases of minors being sexually assaulted has shown an upward trend,which not only causes physical and mental harm to the involved minors,but also results in greater harm than adults in similar cases,and is sustainable.Under the current legal system in our country,although minor victims receive compensation for mental damages through criminal incidental civil actions,there is little support from the courts in practice.Even if supported,the amount is lower than similar compensation in civil law infringement,which is not enough to soothe the injury and cannot serve as a punishment for criminals.In view of this,China should establish special rules for such cases,add punitive compensation for mental damages,and coexist civil and criminal compensation.
