摘要
“努力让人民群众在每一个司法案件中感受到公平正义”的重要论述,让挖掘“感知司法正义”的理论内涵和实践机制成为构建中国法学自主知识体系的重要任务。从自下而上的向度出发,以社会公众对司法公平正义感知的内在生成结构为分析主干,对江歌案的公共话语样本编码并进行话语分析研究。归纳出以“话语汲取”为中心的感知司法正义的二阶塑造机制,揭示其基础是以“利用话语”为行动模式的主体间互动关系。在此基础上,基于哈贝马斯的沟通行动理论,提出通过“有效宣称”构建“交往理性”这一打通感知司法正义最后一公里的可能路径。
The important elaboration“letting the people feel justice in each judicial case”causes excavating the theoretical connotation and practical mechanism of“perception of judicial justice”to be the core task of Chinese modernization practice of rule of law and the construction of Chinese autonomous law knowledge system.viewed from the bottom-up approach,taking in-built generation structure of people's perception of judicial justice as the analytic stem,the samples of public discourse of Jiang Ge case are coded and analysed from the perspective of discourse.The second-order molding mechanism of perception of judicial justice focusing on“discourse extraction”is summed up,the foundation of interactions between subjects with action pattern of“with the discourse”is thus unveiled.with that,based on the theory of communicative action by Jürgen Habermas,the communicative rationality as the possible path of getting through the last mile to perceive judicial justice is constructed by advocating validity claims.
