摘要
我国尚未创设少年法院,相关问题值得系统深入地再研究。梳理总结起来,这些问题主要包括三类九项:其一,是否创设?主要包括我国少年法院创设的必要性、可行性以及试点改革等三项问题。其二,如何创设?即我国少年法院创设技术操作性的系统方案问题,主要包括审级设置、案件管辖和内设庭室等三项问题。其三,如何发展?创设之初的少年法院必然不够完善,那么就必然需要系统考虑其未来发展完善的策略问题。其主要涉及相应的系统实践、系统立法和系统理论等三项问题。
The efforts to set up juvenile courts in China has not been successful yet,the related issues need to be re-studied deeply and systematically.To sum up,these issues mainly include nine items in three categories.Firstly,to set up or not?That includes the issues of necessity,feasibility and experimental reform of the juvenile courts in China.Secondly,how to set up?That is the systematic plan to set up juvenile courts in China,which mainly includes the issues of trial grade,case jurisdiction and internal courts.Thirdly,how to develop?The newly established juvenile courts would not be perfect for sure,and must need to consider its future development strategy,which includes the issues of systematic practices,legislations and theories.
