摘要
国家监察体制改革未动摇检察机关法律监督机关的宪法定位。检察机关提前介入监察调查是落实监检互相配合、互相制约关系的重要机制,兼具履行法律监督与实现诉讼职能的双重价值属性。现阶段检察机关提前介入监察调查实践中普遍存在提前介入时间不充裕、角色定位错位、提前介入率过高和被调查人权利救济机制缺位等难题。消解的路径宜从提前介入时间节点的合理选择、检察机关角色的应然定位、限定适用提前介入的案件范围,以及明确监察调查阶段被调查人获得法律帮助的权利等方面加以规范。
The reform of the national supervision system has not shaken the constitutional position of the legal supervision organs of the procuratorial organs.The procuratorial organs’early intervention in the supervision and investigation is an important mechanism to implement the relationship of mutual cooperation and mutual restriction between the procuratorial organs and supervisory organ,and also has the dual value attribute of performing legal supervision and realizing the litigation functions.At the present stage,in the practice of procuratorial organs’early intervention in the supervision and investigation,there are many problems such as the insufficiency of early intervention time,the misplacement of role,the excessiveness of early intervention rate and the absence of relief mechanism for the rights of the persons investigated.The path of dissolution should be standardized from the reasonable selection of early intervention time,the proper role of procuratorial organs,limiting the scope of early intervention,and clarifying the rights of the respondent to obtain legal help in the supervision and investigation stage.
