摘要
新就业形态以互联网平台作为组织方,将分散的灵活就业组织起来,赋予灵活就业新的内涵,并对促进就业创业、拓宽劳动收入渠道等发挥着重要作用。为此,保障新就业形态劳动者权益成为当务之急。目前来看,我国新就业形态劳动者权益保障面临着诸如相关法律法规不健全、社会保险参与程度低、平台算法存在不合理和监管与参与亟待加强等现实困境。为此,该文提出要健全相关法律法规、完善社会保险制度、规范平台算法规则和推进多元协同治理等具体对策,以期为这一新型就业群体合法权益保障落地建言献策。
Organized by the Internet platform,the new employment form gathers the decentralized flexible employment together,gives this kind of employment a new connotation,and plays an important role in promoting employment and entrepreneurship,broadening the channels of labor income,etc.Therefore,it is imperative to protect the rights and interests of the workers in the new employment form.At present,the protection of the rights and interests of them is faced with realistic difficulties,such as imperfect laws and regulations,low participation in social insurance,unreasonable platform algorithms,and urgent need to strengthen supervision and participation.Therefore,in order to provide suggestions for the protection of the legitimate rights and interests of this new employment group,this paper puts forward specific countermeasures such as improving relevant laws and regulations,perfecting the social insurance system,standardizing the platform algorithm rules and promoting multiple collaborative governance.
