摘要
快递行业的蓬勃发展为人们的生活带来巨大便利的同时,其中的物品损害赔偿问题也成为了司法实践中的难点。现行法律法规虽然对快递服务赔偿责任进行了规范,但同案不同判的现象屡见不鲜。文章对快递服务合同的性质进行分析,认定其为第三人利益合同,收件人享有独立的损害赔偿请求权,并将《中华人民共和国民法典》(下称《民法典》)作为损害赔偿的法律依据,通过分析进一步发现,法院对保价条款的效力认定不统一、保价金额与实际物品损失金额之间不对等、免责条款范围较宽泛等是保价条款中存在的主要问题。因此,有必要统一保价条款的效力认定标准,对特殊保价物品进行特殊规定,对免责条款进行相应规制。
The vigorous development of express delivery enterprises has brought great convenience to people's lives,while the issue of compensation for damage to goods has also become a difficult point in judicial practice.Although current laws and regulations regulate the liability for compensation for express delivery services,it is not uncommon for different judgments to be made in the same case.This paper analyzes the nature of express delivery service contracts and identifies them as third-party interest contracts.The recipient has an independent right to claim damages,and the Civil Code of the People's Republic of China(hereinafter referred as the Civil Code)is used as the legal basis for damages.Based on further analysis,it is found that the court's inconsistent determination of the effectiveness of the insurance clause,the imbalance between the insured amount and the actual loss amount of the item,and the wide range of exemption clauses are the main problems that exist in the insurance clause.Therefore,it is necessary to unify the standards for determining the effectiveness of insurance clauses,make special provisions for special insured items,and regulate exemption clauses accordingly.
