摘要
信息处理者使用人脸识别技术处理个人信息若以公共利益为目的,可免于承担侵权责任。然而,法律规范并未明确界定何为公共利益,实践中以目的限制原则对公共利益进行约束效果甚微,随意适用及滥用问题突出。在个人信息领域有针对性地对公共利益进行规制,亟须明确公共利益代表者,建立独立的个人信息监管机构。公共利益范围的完整界定需要从正反两面入手:公共利益范围类型化与排除假冒情形。程序上应当预先告知个人信息收集目的,对涉及公共利益问题双方争议较大时召开听证会加以解决。
Information processors who use facial recognition technology to process personal information for the purpose of public interest are exempt from liability for infringement.However,legal norms do not clearly define what public interest is,and in practice,the principle of purpose restriction has limited effect on restraining public interest,resulting in prominent issues of arbitrary application and abuse.In order to regulate the public interest in the field of personal information,it is urgent to define the representative of public interest and establish an independent personal information regulator.The complete definition of the scope of public interest needs to start from both positive and negative aspects:typification of the scope of public interest and the elimination of counterfeit situations.In terms of procedures,the purpose of personal information collection should be notified in advance,and a hearing should be held to resolve disputes involving public interests between both parties.
