摘要
社会的现实需求与国家的顶层设计推动了公益诉讼受案范围的逐步扩大,也让惩罚性赔偿制度与公益诉讼的结合适用于更多领域。涉水民事公益诉讼同生态环境保护民事公益诉讼在客体保护方面具有价值的一致性。将惩罚性赔偿制度引入涉水民事公益诉讼也是实现水行政机关诉权和完善法律体系的重要保障之一。对涉水民事公益诉讼受案范围的梳理与分类是制度构建的基础。功能与效果的统一以及惩罚性赔偿金的管理模式应当结合实际情况,着重予以考量。
The practical needs of society and the top-level design of the country have driven the gradual expansion of the scope of public interest litigation cases,and have also made it possible for the punitive compensation system to be applied in more fields through its combination with public interest litigation.The civil public interest litigation involving water and the civil public interest litigation for ecological environment protection have value consistency in object protection.Introducing the punitive compensation system into water related civil public interest litigation is also an important guarantee for realizing the litigation rights of water administrative agencies and improving the legal system.The sorting and classification of the scope of accepting cases in water related civil public interest litigation is the foundation of institutional construction.The unity of function and effect,as well as the management model of punitive damages,should also be considered in conjunction with actual situations.
