摘要
随着法律职业伦理成为法学本科专业必修核心课程,中国政法大学等高校建立起法律职业伦理这一二级学科,法律职业伦理的学科发展呈现出初步繁荣景象。但是,对于法律职业伦理本科阶段和研究生阶段的课程究竟应该如何开设、主要讲授什么内容,学界尚没有形成共识。专业是高等教育的基本单元,学科是特定专业的知识体系,课程是专业教育的载体,是学科传承的依托。对于法律职业伦理来说,完成课程体系建设对于本学科的发展来说至关重要。法律职业伦理课程体系建设应明确其法学专业课的基本定位,将其理论课程和实践课程兼具的课程品性贯彻落实到课程建设之中,实现理论与实践相结合、必修与选修设置结合、总论与分论均衡设置相结合。在设置路径上,兼顾专业理论课和专业实践课的设置特点,优化课程建设路径,并统筹协调好其与“习近平法治思想概论”课程、纯法律实践类课程、法律专业类课程以及统一法律职业资格考试之间的关系,实现法律职业伦理课程体系的优化建设。
With legal ethics becoming a mandatory core course for undergraduate law majors,universities such as China University of Political Science and Law have established secondary disciplines of legal ethics,and the development of legal ethics has shown a preliminary prosperity.However,there is still no consensus in the academic community on how to offer courses in the undergraduate and graduate stages of legal ethics,and what the main content should be taught.The major is the basic unit of higher education,the discipline is the knowledge system of a specific major,and the curriculum is the carrier of professional education and the basis for the inheritance of the discipline.For legal ethics,completing the construction of the curriculum system is crucial for the development of this discipline.The construction of the legal ethics curriculum system should clarify the basic positioning of its legal courses,implement the curriculum characteristics of both theoretical and practical courses into the curriculum construction,complete the reasonable start of the necessary and elective course modules,and achieve the combination of theory and practice,the combination of compulsory and elective courses,and the balanced setting of general and sub topics.
