摘要
为整治非法欠债不良现象,建立个人破产制度是当务之急,而个人破产的失权与复权制度是其中的一个重要内容,很大程度上影响其实施效果。我国应选择裁判形成主义的失权模式与混合复权主义的立法模式。在个人破产失权与复权制度的具体内容设置方面,经营性主体与消费性主体均应被纳入调整范围,对于失权限度采取动态弹性主义,使有关部门可以在法定范围内根据具体案件类型设定恰当的失权期限与失权范围,主要设置破产人依法清偿债务或其债务被依法减免、与债权人达成和解协议并依法履行完毕以及失权达到法定期限三种复权情形。
The establishment of personal bankruptcy system is a priority to address the undesirable phenomenon of illegitimate indebtedness.The system of loss of rights and restoration of rights,as an important part of personal bankruptcy system,affects its implementation effect to a great extent.Our country should choose the loss of rights model based on the formation of judgments and legislative model based on the restoration of rights.In terms of the specific content setting of the personal bankruptcy loss and restoration system,both business entities and consumer entities should be included in the adjustment scope.As for the limitation of the loss of rights,it is necessary to adopt the dynamic elasticity so that the relevant departments can set the appropriate period and scope of the loss of rights within the legal scope according to the specific types of cases.Three types of restoration situations can be set up,namely,the bankrupt pays off his debts or his debts are reduced according to the law,a settlement agreement with creditors is reached and fulfilled in accordance with the law,and the loss of rights reaches the legal deadline.
