摘要
为完善我国处方药网络销售监管制度提供参考,通过中外文献调研、中外管理机制实际查证、深入对比分析等方式,系统梳理中美处方药网络销售监管依据,对比中美监管机构、监管模式等差异特点,分析我国处方药网络销售面临的机遇和瓶颈,提出我国处方药网络销售监管制度的完善建议。得出结论,美国处方药网络销售监管立法内容相对完善,监管机构多元,监管模式趋于成熟,具有重要借鉴意义。针对我国处方药网络销售监管制度存在的立法位阶较低、法律内容不完善,监管主体力量单一等问题,建议优化顶层设计,推进社会共治,构建处方药网络销售智慧监管体系,为完善我国网售处方药监管制度提供参考。
Objective:To provide reference for improving the regulatory system of prescription drug online sales in China.Methods:Through research of Chinese and foreign literature,practical investigation of Chinese and foreign management mechanisms and in-depth comparative analysis,the paper sorted out the regulatory basis of prescription drug online sales in China and the United States and compared the regulatory agencies and regulatory models of prescription drug online sales between the US and China,to analyze the development opportunities and bottlenecks of China's prescription drug online sales regulatory system,and make suggestions for improving China's prescription drug online sales regulatory system.Results and Conclusion:The U.S.prescription drug online sales regulatory legislation is relatively complete,the regulatory agencies are diversified,and the regulatory model tends to be mature,which has important significance for reference.In view of the low legislative status,imperfect legal content and single regulatory body power of China's prescription drug online sales regulatory system,the paper suggested optimizing the top-level design,promoting shared social governance,and establishing a wise regulatory system for the online sale of prescription drugs,which will provide references for improving China's online prescription drug sales regulatory system.
