摘要
根据我国《民法典》的规定,代书遗嘱和打印遗嘱除了应符合法律规定的实质要件外,还应当符合法律规定的形式要件。人民法院创造性地总结出代书遗嘱和打印遗嘱“时空一致性”的裁判规则,并在司法实践中得以运用,对正确审理继承案件、保护当事人权益起到了积极的作用。但目前各地人民法院对“时空一致性”裁判规则的理解与把握尺度不一,在一、二审法院中也产生了“同案不同判”的情况。我们应当将“时空一致性”裁判规则与《民法典》规定的遗嘱形式要件规则加以融合,适时出台规范性文件,将“时空一致性”规则融入形式要件,坚持以“强制性规则”为普遍适用、“补强规则”为特殊适用,逐步解决目前办案过程中存在的困惑。
According to the provisions of China's Civil Code,in addition to the substantive elements of the law,the written will and printed will should also conform to the formal elements of the law.The people's court creatively summed up the"spatio-temporal consistency"of written wills and printed wills,and applied it in judicial practice,which played a positive role in correctly hearing inheritance cases and protecting the rights and interests of the parties.But at present,the understanding and grasp of the"spatio-temporal consistency"adjudication rules of the local people's courts are different,and the situation of"same case and different judgment"has also arisen in the courts of first and second instance.We should integrate the"spatiotemporal consistency"judgment rule with the rules of the will form elements stipulated in the Civil Code,timely issue normative documents,integrate the"spatio-temporal consistency"rule into the formal elements,adhere to the"mandatory rule"as a general application,"reinforcement rule"as a special application,and gradually solve the current confusion in the process of handling cases.
