摘要
我国《继承法》如何跟上时代发展的步伐而得到适当的修正,既是我国法治建设中的一个重大课题,又关系着百姓千家万户的切身利益。透过对时代背景的考察发现,《继承法》必须面对人口老龄化、独生子女家庭增加、社会贫富差距过大等现实问题。《继承法》的修正不仅自身规范体系应协调一致,还应与我国社会主义法律体系相统一,更需要与我国当代社会现实相适应。通过对《〈中华人民共和国继承法〉修正草案建议稿》条文的解读,展示了我国继承法基础理论适应时代的变革与制度创新。
In construction of ruling of law,how to properly modify and update the inheritance law is an essential project,which also concerns the fundamental public interest.Based on the current background,amendments of Inheritance Law should consider such actual issues as the aging population,increase of only-child families and the widening of gap between rich and poor.Amendments of the Inheritance Law should be consistent within the normative system itself.Moreover,it should be compatible with the socialist legal system and the contemporary social reality.The interpretation of provisions of Suggestions on the Draft Amendments to the Inheritance Law has indicated that the fundamental theory of inheritance law has been accustomed to epoch reform and system innovation.
