摘要
党的二十大报告指出深化农村土地制度改革,赋予农民更加充分的财产权,保障进城落户农民的合法土地权益。建立科学合理的农村宅基地自愿有偿退出机制,保障农户宅基地用益物权,盘活农村闲置宅基地,对深化农村土地制度改革,贯彻落实党的二十大精神具有重要的理论价值与实践意义。本文以试点地区进城落户农民宅基地为研究对象,对进城落户农民宅基地退出的实际情况深入调研,发现宅基地退出的主体界定不清、退出的动力不足、退出的补偿标准不合理是制约进城落户农民宅基地退出的主要障碍因素。赋予农民更加充分的财产权益的主要路径是在立法中明晰宅基地主体的权属性质,完善宅基地使用权的处分权能,健全宅基地退出的法律保障体系,建立宅基地退出主体的救济机制。加强宅基地使用权确权制度的顶层设计,发挥市场在资源配置中的作用,最大程度地维护农民在宅基地退出中的合法权益。
The report of the 20th National Congress of the Communist Party of China pointed out the deepening of rural land system reform,granting farmers more full property rights and guaranteeing the legitimate land rights and interests of farmers who settle in cities.The establishment of a scientific and reasonable voluntary paid withdrawal mechanism for rural homestead,the protection of farmers’usufruct of homestead,and the revitalization of idle rural homestead have important theoretical and practical significance for deepening the reform of rural land system and promoting the implementation of the spirit of the 20th CPC National Congress.This study takes pilot areas as the research object and conducts empirical research on the actual situation of homestead withdrawal of farmers who have settled in cities.The unclear definition of the subject of homestead withdrawal,insufficient motivation for homestead withdrawal,and unreasonable compensation standards for homestead withdrawal are the main obstacles that restrict the withdrawal of homestead for farmers who have settled in cities,The main way to grant farmers more full property rights and interests is to first clarify the ownership nature of the homestead subject,improve the disposal power of the homestead use right,improve the legal protection system for homestead withdrawal,and establish a relief mechanism for the homestead withdrawal subject in legislation.By leveraging the role of the market in resource allocation and constructing a top-level design for the confirmation system of homestead use rights,we aim to maximize the protection of farmers’legitimate rights and interests in the process of homestead withdrawal.
