摘要
一桩土地纷争的法律民族志表明,镇域纠纷运动是一个复杂的综合体。在镇域与纠纷运动的互动关系中,最为显著者莫过于镇域纠纷运动二重性:镇(乡)所在物理时空、生活与生产方式、社会观念、个体认知与激情、正式与非正式规则、日常实践与偶发事件等物质及意识,构成纠纷运动的场域/结构,纠纷运动既是镇域在个案中之特定呈现,也对场域/结构之存在形态产生反作用,纠纷运动及其效应更是作为场域/结构之一部分而沉淀于镇域中,往复不止。镇域纠纷运动二重性集中体现为支配与反抗、资源与局限、架构与形塑等彼此依存、相互转化的关系。
The legal ethnography of a land dispute shows that the township field dispute movement is a complex synthesis.In the interaction between the township field and the dispute movement,there is nothing more significant than the duality of the dispute movement in the township field:the physical space and time in which the township(village)is located,the way of life and production,social concept,individual perceptions and passions,formal and informal rules,daily practices and occasional events,and other material and consciousness constitute the field/structure of the dispute movement,which is the specific presentation of the township field in each case and also has a counter effect on the existence form of the field/structure,and the dispute movement and its effects are precipitated in the township field as part of the field/structure,and it goes on and on.The duality of dispute movement in the township is reflected in the interdependence and transformation of domination and resistance,resources and limitations,structure and shape,etc.
