摘要
科技成果利益保护制度能够为创新资源市场配置提供法律基础和行动指南。探索科技成果如何进行权利配置是新时代科技创新与制度协同发展的必然要求。反观科技成果现有法律保护路径,存在对部分有价值的科技成果保护的缺位,在理论上反映了现有知识产权专有权和秩序法无法统筹科技成果财产性所衍生的法律关系。为弥补现有路径的不足,本文提出以科技成果权统筹科技成果利益的权利配置,基于科技成果权财产性和排他性的讨论确定科技成果权应有的法律内涵,并在新时代背景下重新证成和诠释科技成果权,进而提出关于科技成果权权利配置的制度设计建议。
The legal system of protecting the interests of scientific and technological achievements can provide a legal basis and action guide for the allocation of innovative resource markets.Exploring how to allocate rights for scientific and technological achievements is an inevitable requirement for the coordinated development of scientific and technological innovation and institutions in the new era.However,there is a lack of protection for some valuable scientific and technological achievements in the existing legal protection path,which theoretically reflects the inability of existing intellectual property exclusive rights and the anti unfair competition regulations cannot cover the legal relationship derived from the property rights of scientific and technological achievements.To address this issue,this article proposes the legal connotation to the scientific and technological achievements right based on the discussion of its property right attributes and exclusivity.Furthermore,the scientific and technological achievements right should be re-proven and re-interpreted in the context of the new era,based on which the institutional legal suggestions for the allocation of it can be proposed.
