摘要
专利权是以私权为其本质属性,兼具一定公权因素的民事权利。由于专利权的取得、确权、救济程序都存在国家公权力的渗透,有关专利权有效性争议能否提交具有民间性的仲裁机构解决,在理论上一直存在较大的争议,在实践中也易遭受不同问题的阻碍。然而,基于专利权私权的本质属性及仲裁裁决的相对效力理论,相关争议提交仲裁具备理论上的可行性。在仲裁实践中,可通过在立法层面赋予仲裁庭在特定情况下对专利权效力的认定权、明确仲裁裁决的相对效力及特殊情况下的例外规定、建立仲裁机制与行政认定的衔接机制等途径来消除其现实阻碍。由此平衡仲裁权与行政权之间的关系,避免仲裁权对公权力的入侵,使专利权有效性争议也能够通过仲裁获得专业、高效的解决。
Patent right is a civil right which essential attribute is private rights,with certain public power elements.Since the acquisition,confirmation and relief procedures of patent rights are infiltrated by state public power,whether disputes over the validity of patent rights can be submitted to arbitration institutions for settlement have always been relatively controversial in theory,and in practice they are also vulnerable to different problems.However,based on the essential nature of private patent rights and the theory of the relative validity of arbitral awards,it is theoretically feasible to submit relevant disputes to arbitration.In arbitration practice,practical obstacles can be eliminated by giving the arbitral tribunal the right to determine the validity of patent rights under specific circumstances,clarifying the relative validity of arbitral awards and exceptions under special circumstances,and establishing a linkage mechanism between arbitration mechanism and administrative determination.Balance the relationship between arbitration power and administrative power,avoid the intrusion of arbitration power on public power,and enable disputes over the validity of patent rights to be resolved professionally and efficiently through arbitration.
