摘要
社交账户具有人格和财产双重属性,符合虚拟财产的定义和特征,具有可继承的合理性。社交账户按照用户使用目的可以分为营利性社交账号和非营利性社交账户。司法实践中已经有案例支持虚拟财产可转让和继承,可从规范和完善用户协议、引入第三方信息管理机构、借鉴域外仅公开账户内信息等方面探索社交账户继承的路径。
Social accounts have dual attributes of humans and property,which conform to the definition and characteristics of virtual property and are reasonable for inheritance.Social accounts can be divided into profit and non-profit social accounts based on the user s usage purpose.There are already cases in judicial practice that support the transferability and inheritance of virtual property.We can explore the path of social account inheritance from aspects such as standardizing and improving user agreements,introducing third-party information management agencies,and learning from external sources to only disclose account information.
