摘要
网络暴力在实质上为不同于传统“硬暴力”“软暴力”的特别“软暴力”,具有施行不明真相道德绑架的煽动性、制造群体精神折磨的欺凌性和引发范围不可控的群体性等独有特征。这些特征决定了,网络暴力的行为方式并不契合《征求意见稿》按现行刑法规定所构建的法律适用规则,难以按相应犯罪定罪处刑。网络暴力行为的刑法适用规则构建,需要针对网络暴力的独有特征,基于保证充分言论自由、坚守刑法基本原则、基于“暴力”的实质、贯彻宽严相济政策等立场,将那些造成严重后果的网络语言性、人肉搜索性和寻衅滋事性网络暴力行为,分别扩大解释适用到诽谤罪、侮辱罪、侵犯公民个人信息罪和寻衅滋事罪的行为方式中,并对其刑法适用规则进行体系化与整体性评价与适用。
Cyber violence is in essence a special kind of"soft violence"that is different from the traditional"hard violence"and"soft violence",with unique characteristics such as incitement to commit moral abduction without knowing the truth,bullying to create group mental torture,and triggering an uncontrollable range of groups.In this regard,the conducts of cyber violence cannot fit the applicable provisions constructed by the Exposure Draft in accordance with the existing criminal law and are difficult to be convicted and sentenced in accordance with the corresponding offences.The construction of criminal applicable rules to cyber violence should focus on its unique characteristics and based on the positions of guaranteeing full freedom of expression,adhering to the basic principles of criminal law,On the essence of"violence",and carrying out the policy of leniency and severity,etc.Cyber violence like cyber insulting,human-flesh search and provocation that have serious consequences should be interpreted expanded as conducts of the offences of defamation,insult,infringement of personal information and provocation of trouble respectively,and be evaluated and applied systematically and holistically in accordance with the existing criminal law.
