摘要
目的性论证的形式化既体现了法律解释理论的时代延伸与演化,又是在法律解释与论证中融入人工智能成果而形成的一种研究趋向。作为一种论证型式,目的性论证源自作为解释规准的“目的解释”;而目的性论证的形式化源于对人工智能法律建模的反思。在法律人工智能语境下,目的性论证的形式化涉及知识表示中引入目的与价值、价值权衡的形式化、作为一种论证型式的形式化。但是,目的性论证的形式化还面临知识表示难题、价值排序难题、实践性难题。这些难题的解决需要运用文本解析技术辅助知识表示、以后果考量化解价值评价难题、模型设计要为法官裁量保留适当空间。
The formalization of teleological argument not only reflects the age extension and evolution of legal interpretation theory,but also is a research trend formed by incorporating artificial intelligence achievements in legal interpretation and argumentation research.As a kind of argumentation scheme,"teleological argument"derives from"purposive interpretation"as a canon of interpretation,while the formalization of teleological arguments stems from reflection on legal modeling of artificial intelligence.In context of legal artificial intelligence,the formalization of teleological argument specifically involves the introduction of purpose and value into knowledge representation,formalization of the balance of value,and formalization of teleological argument as a type of argumentation.However,the formal research of teleological argument is also faced with the problems of knowledge representation,value ranking and practical problems.The solution of these problems not only requires the use of text analysis to assist knowledge representation,but also depends on the consideration of consequences to solve the value evaluation problems,and the model design should also reserve proper space for judge's discretion.
