摘要
基因信息的专属性、共享性及稳定性等特征,决定了基因信息的功能多元化和高度敏感性,它应作为一种具有财产性利益的个人信息权而予以保护。基因信息检测技术应用于工作场所,有其客观的外在功能需求和内在价值特性;工作场域下基因信息的应用存在多方利益主体,各方对基因信息披露的利益需求也不尽相同,故须充分考量所涉基因信息的权利属性和各方价值需求,以优越利益法理作为根本判断标准,基于目的和手段的正当性以及社会伦理规范等来对冲突利益作比较衡量,从而合理规范基因信息在工作场所中的应用方式和应用限度。
The specificity,sharing,and stability of genetic information determine its functional diversity and high sensitivity,and it should be protected as a personal information right with property interests.The application of gene information detection technology in the workplace has its objective external functional needs and intrinsic value characteristics.There are multiple stakeholders in the application of genetic information in the workplace,and all parties have different interest needs for the disclosure of genetic information.Therefore,it is necessary to fully con⁃sider the right attribute of the genetic information involved and the demand value of all parties,take the superior in⁃terest jurisprudence as the fundamental judgment standard,and compare and measure conflicting interests based on the legitimacy of purposes and means as well as social ethical norms.In order to reasonably regulate the application of genetic information in the workplace and application limits.
