摘要
保护作品完整权对“歪曲、篡改”的认定以作者为本位,忽视了读者在创作中的功能和作用,可能导致优秀再创作面临侵权的风险。作者对作品的绝对解释源于保护作品完整权形成了天才的作者、情感表白的作品、客观性理解的基本结构。利用接受美学对以上要素进行解构,可以发现天才理念有失偏颇,作品与读者的关系密切,对作品的理解具有不可摆脱的个体性和历史性。为了淡化作者至上的浪漫主义色彩,防止保护作品完整权的滥用,可综合借鉴大陆法系和英美法系的规定。就保护作品完整权的侵权标准而言,在种类甄别的基础上,对文艺作品、科学作品中的图形作品、模型作品和计算机软件适用损害作者声誉标准,对其他科学作品适用违背作者意思标准。
The determination of“distortion and mutilation”in the right of integrity is based on the author,which ignores the function and role of the reader in the creation.It may lead excellent re-creation to the risk of infringement.The author’s absolute interpretation of the work stems from the basic structure of talented authors,works of emotional expression,and objective understanding.When Reception Aesthetics is adopted to deconstruct those structures,it is found that the concept of genius is biased.The relationship between works and readers is close,and the reader’s understanding is irresistibly historical and individual.In order to dilute the romanticism of author supremacy and prevent the abuse of the right of integrity,it can comprehensively refer to the rules of Continental law system and Anglo-American law system.In terms of the infringement standard for the right of integrity,on the basis of genre screening,the standard of being prejudicial to the author’s reputation is to be applied to literary and artistic works and graphic works,model works and computer software of scientific works,and the standard of deviating from the author’s intention is to be applied to other scientific works.
