摘要
能动司法是审判机关在习近平法治思想指引下,紧密围绕全面依法治国这场深刻革命进行的具体实践,是人民法院为适应新时代新形势新任务新要求、促进审判工作高质量发展的需要和充分发挥审判职能的客观要求进行的积极探索。只有深刻把握新时代能动司法的重要意义和深刻内涵,不断深化能动司法实践,加强理论实践互动,构建体现中国特色的新时代司法理论体系,才能实现为大局服务、为人民司法的审判理念。本刊组织了三位学者,以“新时代人民法院能动司法”为笔谈主题,通过对能动司法的理论逻辑、实践逻辑等方面进行剖析,勾画新时代人民法院能动司法的理论蓝图和实现路径。
Active judiciary is a specific practice of the judiciary under the guidance of Xi Jinping Thought on the Rule of Law,closely centering on the profound revolution of the rule of law in all aspects,and is a positive exploration by the people's courts to adapt to the new situation and new tasks of the new era,the need to promote high-quality development of the trial work,and the objective requirement of giving full play to the function of the trial.Only by profoundly grasping the signifi cance and profound connotation of active judiciary in the new era,continuously deepening the practice of active judiciary,strengthening the interaction between theory and practice,and constructing a judicial theory system of the new era that embodies Chinese characteristics,can we realize the concept of trial that serves the overall situation and administers justice for the people.This Journal has organized three scholars to discuss the theme of"Active judiciary in the People's Courts in the New Era",and to analyze the theoretical and practical logic of active judiciary,so as to outline the theoretical blueprint and path of realization of the active judiciary in the People's Courts in the new era.
