摘要
随着经济全球化进程的不断发展,物流行业也进入了发展的高速期,特别是在网络购物激增与商品交易加快的背景下,对物流行业来说起到了一定的积极作用,同时也使物流行业迎来了一个巨大的挑战。由于我国目前的法律规范已不能适应现实物流行业发展的需要,在立法上,没有综合性的法律法规提供相应的制度保障;在实践中,没有统一的原则地方性法规的建立。因此,在物流法律制度方面还存在诸多问题亟需完善,故文章将从我国目前物流行业发展的实际出发,分析我国现有的相关法律制度存在的问题,并针对问题提出相应的完善建议,从而促进物流行业的发展。
With the continuous development of the process of economic globalization,the logistics industry has also entered a high-speed period of development.Especially in the context of the rapid increase of online shopping and accelerated commodity exchange,it has played a positive role in the logistics industry,but also brought a challenge to the logistics industry.As the current legal norms in our country do not respond positively to the needs of the development of the logistics industry,there are no comprehensive laws and regulations in legislation to provide corresponding system guarantees,and there are no unified guiding principles in practice to guide the establishment of local laws and regulations,so there are still many problems in the logistics legal system that need to be improved.This paper tries to start from the current development of China's logistics industry,analyze the problems existing in the legal system,and put forward corresponding suggestions for improvement to promote the development of the logistics industry.
