摘要
在数字化与老龄化交织的今天,老龄人似乎失去了“安身之所”,银发一族成了数字社会的“难民”。老龄人的数字困境实质是权利困境。老龄“数字难民”权利在数字社会集中呈现为数字化生活权,是数字时代老龄人追求幸福生活的最重要诉求。作为新兴权利,老龄“数字难民”权利具有伦理与法理上的可证成性、权利结构上的可构造性和法律上的可型塑性。老龄“数字难民”权利是一个包括接入权、数字受教育权、断连权、被遗忘权等内容的权利束,具有可变性、延展性等特征。
In the digital and aging era,the elderly seem to lose the"place of abode"and has become the"refugees"of the digital society.In essence,the digital dilemma of the elderly is a dilemma of rights.The rights of the elderly"digital refugees"in the digital society are presented as the digital life right,which is the most important appeal of the elderly in the pursuit of a happy life in the digital era.As a new right,the rights of the elderly"digital refugees"have the ethically and legally verifiable,the structurability of the right structure and the legal plasticity.The rights of elderly"digital refugees"are a bundle of rights in terms of access,digital education,disconnection,as well as the right to be forgotten and so on.These rights are changeable and malleable.
